1. The Elevate Card Service

The Elevate Card is an NFC-enabled product that provides access to digital motivational content and related interactive features. Depending on the edition and available features, the experience may include adaptive speeches, progress or levels, a personal library, liked or previously viewed content, a journal, and other features that may evolve over time.

No account or login is currently required to access the core experience. Certain functionality may depend on a compatible device, internet connection, browser settings, or the continued availability of supporting technology.

2. Personal and Permitted Use

The Elevate Card and its digital experience are provided for personal, lawful use. You may not misuse the service, interfere with its operation, attempt to gain unauthorized access to its systems, circumvent technical restrictions, or use the service in a way that violates applicable law or the rights of others.

3. Motivational Content

Content provided through The Elevate Card is intended for motivational, informational, and entertainment purposes. It is not medical, mental health, financial, legal, employment, fitness, or other professional advice and should not be treated as a substitute for advice from a qualified professional.

Some editions or characters may intentionally use direct, sarcastic, challenging, or tough-love language as part of the product experience.

4. Journal and User Content

The journal and similar features may allow you to enter your own notes or other content. You are responsible for the information you choose to enter and should avoid submitting unlawful content or information you do not have the right to use.

Your use of journal information and other personal information is also subject to our Privacy Policy.

5. Purchases, Shipping, and Returns

Products purchased through Amazon are also subject to Amazon's applicable purchasing, payment, shipping, return, and marketplace terms and policies. iZoomIn LLC does not directly process payment card information for purchases made through Amazon.

Any additional shipping or return terms published by The Elevate Card apply to the extent relevant to the method through which a product was purchased.

6. Intellectual Property

The Elevate Card name, branding, designs, characters, graphics, software, audiovisual material, speeches, written content, and other content made available through the service are owned by or licensed to iZoomIn LLC and are protected by applicable intellectual property laws.

Except as permitted by law or with our written permission, you may not copy, reproduce, distribute, sell, publicly display, republish, modify, create derivative works from, or commercially exploit our content or branding.

7. Availability and Changes

The Elevate Card is designed as an evolving digital experience. We may add, modify, replace, suspend, or discontinue content, features, functionality, or technical elements from time to time. We do not guarantee that any particular speech, character, feature, or piece of content will remain available indefinitely.

We may also perform maintenance or make changes that temporarily affect access to the service.

8. Third-Party Services and Links

The website or service may link to or interact with third-party services, including Amazon and social media platforms. Those services are operated independently and are governed by their own terms and privacy practices. We are not responsible for the content, availability, or practices of third-party services.

9. Disclaimer of Warranties

To the extent permitted by applicable law, The Elevate Card, website, digital experience, and related content are provided "as is" and "as available." We do not guarantee uninterrupted or error-free operation, compatibility with every device or browser, or that the service will always meet every user's expectations.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

10. Limitation of Liability

To the fullest extent permitted by applicable law, iZoomIn LLC and its owners, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of or inability to use The Elevate Card or its digital services.

Any limitation in these Terms applies only to the extent permitted by law and does not limit liability that cannot legally be limited or excluded.

11. Termination or Restriction of Access

We may restrict or terminate access to the service when reasonably necessary to address misuse, unlawful activity, security risks, interference with the service, or violations of these Terms.

12. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles, except where applicable law requires otherwise.

13. Changes to These Terms

We may update these Terms as The Elevate Card evolves or as our legal, technical, or business practices change. When we make changes, we will update the effective date above. Your continued use of the service after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
